1. Agreement Between You and R.E. Technologies (Apartment Matching). The following terms and conditions (the "Terms and Conditions") apply to all visitors to or users of this Web site. By accessing this Web site, the user acknowledges acceptance of these Terms and Conditions. In the case of any violation of these Terms and Conditions, R.E. Technologies, Inc. and its subsidiaries, (collectively, "R.E. Technologies (Apartment Matching)"), reserve the right to seek all remedies available by law and in equity for such violations.

2. General Use Provisions; and Copyright. All materials provided on this Web site, including but not limited to all text, logos, designs, graphics, images, sounds, information, software, documents, products and services (collectively, the "Materials"), and the selection, arrangement and display thereof, are the copyrighted works of R.E. Technologies (Apartment Matching) and/or its vendors or suppliers. All Materials herein and all R.E. Technologies (Apartment Matching) software are proprietary to R.E. Technologies (Apartment Matching) and protected by worldwide copyright and other intellectual property laws. Except as stated herein, none of the Materials may be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means, without the prior express written permission of R.E. Technologies (Apartment Matching).

3. Limited License. R.E. Technologies (Apartment Matching) hereby authorizes you to view, copy, download and print the Materials available on this Web site, provided that: (1) if you are a potential or actual renter, the Materials are used solely for personal, non-commercial purposes and if you are a property owner/manager, the Materials are used only for the purposes of using the services expressly offered by R.E. Technologies (Apartment Matching); (2) the Materials are not modified or redistributed; and (3) all copyright, trademark, service mark and other proprietary notices are reproduced as they appear in any such Materials. Except as expressly provided above, nothing contained herein shall be construed as conferring, by implication, estoppel or otherwise, any license or right under any patent, trademark or copyright of R.E. Technologies (Apartment Matching).

4. Trademarks. The trademarks, trade names, and service marks (the "Marks") displayed on this Web site are the property of R.E. Technologies (Apartment Matching) or other third parties. Users are not permitted to copy or otherwise use these Marks without the prior written consent of R.E. Technologies (Apartment Matching) or such third party which may own the Mark. 5. Compliance with Laws; Export Controls. You acknowledge that the software and any accompanying documentation and/or technical information is subject to applicable export control laws and regulations of the U.S.A. You agree not to export or re-export the software, directly or indirectly, to any countries that are subject to U.S. export restrictions.

6. Devices. You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our Web pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the R.E. Technologies (Apartment Matching) site or any listing, offer or transaction being conducted on our site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

7. No Unlawful or Prohibited Use. As a condition of your use of this Web site, you warrant to R.E. 12. Modification of These Terms of Use. R.E. Technologies (Apartment Matching) reserves the right to change the terms, conditions, and notices under which this Web site is offered at any time. Modification of this contract will be deemed effective upon publication on the Web site with respect to any Renters or Lessor actions, communications or transactions occurring after said date. It is your responsibility to check terms and conditions of this Agreement at the time of each use.

13. Severability. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. R.E. Technologies (Apartment Matching) is licensed as a Real Estate Broker in the State of Texas and those states where it believes it may be necessary to do so in order to comply with state regulations. While R.E. Technologies (Apartment Matching) is licensed in certain states, R.E. Technologies (Apartment Matching) does not render legal, brokerage, or other professional advice or services to either its Renter or Lessor customers.

14. General. This agreement is governed by the laws of the State of Texas, without regard to its conflicts of laws principles. You hereby consent to the exclusive jurisdiction and venue of courts in Dallas County, Texas, in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

15. Services Not Provided. In connection with your use of R.E. Technologies (Apartment Matching)'s website and/or services, you acknowledge and agree as follows:

          I.      R.E. Technologies (Apartment Matching) does not participate in any actual lease transactions, including, without limitation, negotiations, discussions, or proposals;

         II.      While R.E. Technologies (Apartment Matching) has licensed brokers in those states where it believes it may be necessary to do so in order to comply with state regulations, R.E. Technologies (Apartment Matching) does not render legal, brokerage, or other professional advice or services;

        III.      R.E. Technologies (Apartment Matching) is not undertaking any, and has no, fiduciary duties to either Renters or Lessors, including, without limitation, the obligation to inspect rental properties or to verify the veracity of information contained in a preview of your property or Offers;

         IV.      R.E. Technologies (Apartment Matching) is not responsible for the content of, nor does it endorse, the third-party websites to which you may link using this website;

          V.      R.E. Technologies (Apartment Matching) does not guarantee the accuracy of any information available on this website, and is not responsible for any errors, omissions, or misrepresentations, whether made by Renters or otherwise and all information obtained on this website or from Renters must be verified independently;

         VI.      R.E. Technologies (Apartment Matching) may make changes to its products and/or services and this website at any time and without notifying you or receiving your consent; and while R.E. Technologies (Apartment Matching) complies with state and federal civil rights laws, R.E. Technologies (Apartment Matching) does not monitor transmissions of information by Renters and Lessors and thus assumes no liability for Renters' and/or Lessors' failures to comply with such laws.

1. Collection of Personally Identifiable Information

We collect personally identifiable information (email address) from you when you set up a free account with R.E. Technologies, Inc.,(Apartment Matching) While you can browse some sections of our site without being a registered member, certain activities (such as searching for properties, viewing property contact information, and registering a property) do require registration.

We do use your contact information to send you rental listings as well as reminders to report your lease and receive R.E. Technologies, Inc., (Apartment Matching) Rewards. You may always opt-out of receiving such information.

R.E. Technologies, Inc., (Apartment Matching) Renters:
Our site requires you to give us contact information (email address). We use this information to create a unique user account, and to send you relevant apartment listings, reward claim reminders, and offers for moving-related services.

R.E. Technologies, Inc., (Apartment Matching) Owners & Managers:
Our site's registration form requires you to give us contact information (name, address, phone number, and email address) and billing information. We use this information to establish and/or verify your identity, notify you about communication from R.E. Technologies, Inc., (Apartment Matching) Renters, and enable R.E. Technologies, Inc., (Apartment Matching) Renters to view your property's listing. We use your billing and financial information to invoice you for products and services that you purchase through the site.

2. Use of Demographic and Profile Data

We use personal information to provide the services you request. To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses. We use your personal information to resolve disputes; troubleshoot problems; help promote a safe service; collect fees owed; measure consumer interest in our products and services, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection. Renter User Agreement

1. Terms of Use Between User and Apartment Matching Generally. This is a legal agreement ("Agreement") between R.E. Technologies, Inc. ("ApartmentMatching.com") and you, a Renter using the Apartment Matching service, (“User”). By accessing this Web site, you agree to be bound by this Agreement, R.E. Technologies, Inc., (Apartment Matching) Terms of Use, and by all applicable laws. This Web site is for your personal and noncommercial use only.

2. R.E. Technologies, Inc., (Apartment Matching) Services to You. Apartment Matching provides a medium through which Lessors may place information about their properties before Renters, so that Lessors may advertise to Renters and Renters may communicate with Lessors. As part of these services, Apartment Matching will from time to time send you emails which you agree to receive. You are able to unsubscribe from these emails at any time. See our Privacy Policy for further information. Apartment Matching provides you with only these services. Apartment Matching hereby disclaims any liability based on, but not limited to, the following:

  • Apartment Matching does not participate in any actual lease transactions, including, without limitation, negotiations, discussions, or proposals.

Apartment Matching makes no representations as to individual character, credit worthiness, rental history, or ability of Renters to pay their rent. You hereby agree that in no event shall Apartment Matching or its affiliates and/or suppliers be liable for any direct, indirect, incidental, special, consequential or other damages or losses arising out of or in any way related to the use of this web site or with the delay or inability to use this site, or for any information, products, and services obtained through this site, or otherwise arising out of or related to the use of this web site. This Agreement has legal significance. Users with questions regarding such significance are encouraged to seek the advice of an attorney.

4. User's Representations and Warranties. By using this Web site, you hereby represent and warrant the following.

  • You are of the legal age in your state of residence to make contracts and you therefore possess the authority to enter into this Agreement.
  • You are at least 18 years of age if using the Roommate Service.
  • All information supplied or to be supplied by you relating to this Web site is and will be accurate and complete. You will not impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.
  • You agree that the services of this Web site shall be used only to find residential rental units, in accordance with the process R.E. Technologies, Inc., (Apartment Matching) Web site presents, and information for you or for another person for whom you are legally authorized to act. You will not transmit any content that is unlawful, defamatory, obscene, pornographic, trade libelous, threatening, harassing, tortuous, invasive of another's privacy, hateful, or racially, ethnically, religiously, or otherwise objectionable.
  • You understand that failure to abide by this Agreement may result in denial of access to this Web site.
  • You acknowledge and agree that Apartment Matching’s the sole owner and vendor of the Terms of Use.
  • You agree that no joint venture, partnership, or employment relationship exists between you and Apartment Matching as a result of this Agreement or use of this Web site.

5. Your Information. "Your Information" is defined as any information you provide to us or other users in the course of using this Web site, including, but not limited to, any public message area or through any email feature. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information. Apartment Matching will only use Your Information in accordance with our Privacy Policy. Apartment Matching preserves Your Information in its sole discretion and may disclose such information to third parties to comply with legal process or protect the rights, property, or personal safety of R.E. Technologies, Inc., its users and the public.  

6. Correct, Review, Update, or Delete Your Account Information. Apartment Matching provides all users with the ability to 'opt out' of our email program at any time as well as well as the opportunity to correct, update or delete information stored in their account. To review, modify, or delete your information, log in and select "Update Your Profile".

7. Fees and Services. Creating a listing, searching for and communicating with properties are free services. When you find a home through ApartmentMatching.com, the Lessor whose property you will be renting is responsible for paying Apartment Matching a success fee. You agree to return to the Web site to confirm the terms of the lease so that Apartment Matching can collect its fee from the Lessor.

8. Compliance with Federal and State Civil Rights Acts. Apartment Matching complies with state and federal civil rights laws, including the Fair Housing Act and the Americans with Disabilities Act. By using this Web site you agree to comply with such acts and thus agree to avoid stating any preference based on race, color, national origin, religion, handicap, or any other category. At other locations in this Web site, Apartment Matching may remind you not to include information that is potentially actionable under such laws.

9. Right to Refuse Service. Apartment Matching reserves the right to refuse service to anyone and terminate your account at any time.

10. Violations. Please report any violation of this User Agreement to Apartment Matching Customer Service.

R.E. Technologies, Inc. Property Owner's & Manager's Responsibilities

As a property owner or manager you have a responsibility and a requirement under the law not to discriminate in the rental of property on the basis of race, color, religion, sex, handicap, familial status, or national origin. You cannot instruct your agent to convey on your behalf any limitations in the rental because your agent is bound by law not to discriminate. Agents in a rental transaction are prohibited by law from discriminating on the basis of race, color, religion, sex, handicap, familial status, or national origin. They are prohibited from complying with a request from the property owner or manager to act in a discriminatory manner in the lease or rental. Moreover, a property owner or manager cannot establish discriminatory terms or conditions in the purchase or rental, deny that housing is available, or advertise that the property is available only to persons of a certain race, color, religion, sex, handicap, familial status, or national original.

Renter's Rights

As someone seeking to rent an apartment, home, or condo, you have the right to expect that housing will be available to you without discrimination or other limitations based on race, color, religion, sex, handicap, familial status, or national origin. This includes the right to expect equal professional service, the opportunity to consider a broad range of housing choices, no discriminatory limitations on communities or locations of housing, no discrimination in the pricing or financing of housing, reasonable accommodations in rules, practices and procedures for persons with disabilities, and to be free from harassment or intimidation for exercising your fair housing rights.

The Law

Civil Rights Act of 1866

The Civil Rights Act of 1866 prohibits all racial discrimination in the sale or rental of property.

The Fair Housing Act

The Fair Housing Act declares a national policy of fair housing throughout the United States, making illegal any discrimination in the sale, lease or rental of housing, or making housing otherwise unavailable, because of race, color, religion, sex, handicap, familial status, or national origin.

Americans with Disabilities Act

Title III of the Americans with Disabilities Act prohibits discrimination against persons with disabilities in places of public accommodations and commercial facilities.

The Equal Credit Opportunity Act

The Equal Credit Opportunity Act makes discrimination unlawful with respect to any aspect of a credit application on the basis of race, color, religion, national origin, sex, marital status, age or because all or part of the applicant's income derives from any public assistance program.

State and Local Laws
